Where does your syndicate stand on its obligations?

The regulation has been in force since August 14, 2025, and the deadline for the maintenance logbook and the contingency fund study is August 14, 2028. Since August 14, 2025, every divided co-ownership syndicate in Quebec must be able to produce a syndicate certificate when a unit is sold, and must have, by August 14, 2028 at the latest, a maintenance logbook and a contingency fund study that comply with the regulation. What Bill 16 changed for syndicates

Adopted in 2019, Bill 16 amended the Civil Code of Quebec to strengthen long-term planning in co-ownerships. Three obligations shape most of a board’s work.

Obligation

Contingency fund study

A study by a professional establishes the amounts to set aside for major repairs and the replacement of common portions. It must be updated periodically, and contributions to the fund rest on its conclusions.

Maintenance logbook

A living document listing the building’s components, their condition and the work carried out. It serves to plan maintenance as much as to document the history for future buyers and for the insurer.

An up-to-date declaration of co-ownership, minutes, financial statements, contracts and certificates must be kept and made available to co-owners who ask for them.

The two dates that concern you

August 14, 2025

The regulation came into force. Since that date, the syndicate certificate is required for every sale of a fraction. A seller who cannot obtain this document from their syndicate cannot close normally.

Deadline

August 14, 2028

Deadline to have a maintenance logbook and a contingency fund study that comply with the regulation. Three years feels far away — but a study has to be planned, budgeted and obtained from professionals whose number is limited.

The first deadline has already passed

Many boards believe they have until 2028 for everything. That is true of the logbook and the study, not of the certificate: that one is due today, at every sale in the building.
